Archival Overview
Preeminent 11th-century Shafi'i jurist and diplomat whose 'Al-Ahkam al-Sultaniyya' formulated the foundational theory of Islamic constitutional law.
Biographical Record
Ali ibn Muhammad ibn Habib al-Mawardi was born in Basra and served as judge across northern Iraq before Caliph al-Qadir summoned him to Baghdad, appointing him to the unprecedented supreme judicial post of Aqda al-Qudat (Chief Justice of Judges). He also served as chief caliphal diplomat to the Buyid and Seljuk rulers.
Mawardi was the first political philosopher to systematically codify public constitutional law in Islam. His magnum opus, Al-Ahkam al-Sultaniyya (The Ordinances of Government), established the legal qualifications, duties, and electoral contracts governing the caliph, the ministries, the military, taxation, and judicial oversight, balancing Islamic ethical norms with pragmatic administrative statecraft.
